Windsor Hills Rental Contract
Terms and Conditions of Rental
This vacation rental contract is a legal agreement between RENTAL PROPERTY (also referred to as the "Homeowners" and "Landlord" and "Management Company" and "Property Manger") and you, the Renters (also referred to as "Tenants" and "Guests"). This contract is entered into agreement as of the date when the Renters place their reservation online or by phone, RENTAL PROPERTY will notify the Renters by email when their reservation is confirmed.
Please read this Vacation Rental Lease Agreement thoroughly. Any monies received by RENTAL PROPERTY for occupancy of vacation property indicate the acceptance of the terms and conditions of this Vacation Rental Lease Agreement. It is the responsibility of the guest(s) to be familiar with all policies within this agreement.
In order to hold your reservation, we must receive the deposit and electronically signed rental contract within 24 hours. The full balance will automatically be charged to your credit card 30 days prior to check-in and must be received before entry information and directions to the vacation rental are released.
We, the Renters (also referred to as "Tenants" and "Guests") agree to the following:
Osceola County requires us to charge a 13.5% Occupancy Tax on all rentals.
A 25% non-refundable deposit is required at time of reservation. The full balance will automatically be charged to the credit card on file 30 days prior to arrival.
We will be completely responsible for any and all damage to the property caused by our negligence.
The Guest must ensure that Children are supervised AT ALL TIMES.
We will notify the owners/management company of any damage upon arrival.
We will hold the owners harmless from any and all bodily injury and/or property damage incurred on the property arising out of our negligent acts or omissions. See disclaimer below.
We agree our Credit Card will remain on file and will pay for any items that is reasonably attributable to broken, damaged, or missing items.
We will forfeit the deposits and rental monies if reservation is canceled for any reason.
There are no refunds for early departure.
There are no refunds for weather conditions or acts of God.
All rental monies are due 30 days prior to arrival.
We will not hold the owners responsible for any items left after our check out.
This is not a party house.
This is a NON SMOKING vacation rental.
NO PETS are allowed.
Maximum occupancy is posted and will be followed at all times.
Check-in is at or after 4:00pm and check-out is 10:00Am late check-out is subject to extra rental charges.
The Renter must be 21 years of age to book this Vacation Rental.
Furnishings are subject to change without notice.
Furniture, bedding, mattress pads, utensils or any other property supplied with the rental property must not be taken out or transferred from one property to another. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to the guest(s).
Violation of Agreement - If Guest(s) violates any of the conditions of this Agreement; Agent may terminate this Agreement and enter premises. Upon notice of termination of this Agreement, Guest(s) shall vacate the Premises immediately and forfeit all rents and deposits.
Items Guest(s) Must Provide - Any personal articles, any food and drink items, coffee filters, paper towels, napkins, foil, favorite pillow, videos, *Extra towels for pool and spa usage are suggested.
We reserve the right to refuse service to anyone.
We will not be responsible for accidents or injury to guests or for loss of their money, jewelry or valuables of any kind.
The Management Company makes all reasonable efforts to provide advice and safety information. This information can be found in the Rental Information at the Property. It is the responsibility of the Guest to ensure that they have read and understood the contents and advice given. The management company is willing to provide further information pertaining to the Property providing the Guest has first read the Rental Information located on the Property.
Renters understand that the Homeowners are not responsible for any personal injury. Further that the homeowners are not responsible for any personal injury or loss or damage to tenants' property caused directly or indirectly from foul, inclement weather conditions, Acts of God or nature, or any unforeseeable circumstances.
Under no circumstances will tenants or their guests hold the owners of the Vacation Rental responsible for any damages or claims of any kind resulting from their stay, except for intentional acts of harm.
POOL HEAT ADDENDUM:
Pool Heat is optional and pool heat will be turned on only once full payment has been received. Due to pool heaters having electrical/mechanical components that can sometimes malfunction Home owner cannot be held responsible for any malfunctioning heater. Any days lost will be credited to the guests. The Management Company or Owner will do everything in our power to rectify any problem that may arise in a timely manner.
Electric or natural Gas pool heater charges are additional. Charges commence on the date turned on until the date of departure unless prior arrangements have been made. Average time to heat a pool is 10-12 hours after being turned on. Average temperature of a heated pool is 85-90 degrees; however this can vary based on weather conditions.
CONDITIONS FOR POOL HEAT:
Pool pumps and therefore pool heaters are set to operate for 8 hours maximum.
Tampering with pool settings is strictly forbidden.
Pool heat is for consecutive days only.
A heated pool is kept at approximately 85 degrees.
Where the pool is shared with a spa, the pool heat is shared between the two. It will require 45 minutes to heat the spa once the settings have been turned on.
This agreement and disclaimer applies to Renters and all guests in the Renters' party.
I, the Renter, have read, understand, agree to, and will abide by this rental agreement and all conditions stated herein.
